1. Introduction

These Terms and Conditions ("Terms") govern the purchase, return, exchange, and refund of all physical products purchased directly from Sazerac's Direct-to-Consumer (DTC) websites. By purchasing from our DTC sites, you agree to comply with and be bound by these Terms.

2. Order Processing and Fulfillment

  • Order Confirmation: Upon placing an order, you will receive an order confirmation email. This does not signify acceptance of your order, which occurs upon shipment.

  • Shipping and Handling: Orders are processed within 3-5 business days. Delivery times vary based on location and shipping method selected.

  • Third-Party Logistics (3PL): Orders are fulfilled and shipped through authorized 3PL partners. Tracking information will be provided when available.

3. Payment Terms

  • Accepted Payment Methods: We accept major credit cards, debit cards, and other payment methods as listed at checkout.

  • Pricing: All prices are listed in USD and are subject to change without notice. Taxes and shipping fees will be calculated at checkout.

4. Returns and Exchanges Policy

Eligibility: Products must be returned within 30 days of delivery, unused, unopened, and in original packaging to qualify for a return or exchange.

  • Non-Returnable Items: Perishable goods, personalized items, pet toys and final sale products are non-returnable.
  • Return Process:
  1.     Contact Customer Support at ordersupport@buffalotrace.com to initiate a return.
  2.     Provide proof of purchase and reason for return.
  3.     A return authorization (RA) number will be provided, along with instructions.
  • Return Shipping: Customers are responsible for return shipping costs unless the item was defective or incorrect.

  • Inspection and Approval: Returned items will be inspected upon receipt. Refunds or exchanges will be processed within 5 business days if approved.

5. Refund Policy

  • Refund Method: Approved refunds will be issued to the original payment method.

  • Processing Time: Allow up to 21 business days for the refund to appear on your statement.

  • Deductions: Original shipping fees are non-refundable unless the return is due to a defective or incorrect item. 

6. Replacements

  • Damaged or Defective Products: Contact Customer Support within 7 days of delivery with photos and a description of the issue to request a replacement.

  • Incorrect Items: Report any incorrect items within 7 days for a replacement or corrective action.

7. Cancellations and Modifications

  • Order Changes: Orders cannot be modified once placed. To change an order, it must be canceled and reordered.

  • Cancellations: Contact Customer Support immediately to request a cancellation. If the order has already shipped, it must be processed as a return.

8. Shipping Policies

  • Domestic Shipping: Available within the United States, with exclusions for certain products based on state regulations.

  • Delivery Delays: We are not responsible for delays due to carriers, customs, weather, or other unforeseen circumstances.

9. Lost or Stolen Shipments

  • Reporting Lost or Stolen Packages: If your package is marked as delivered but cannot be located, please take the following steps:

  1.     Verify the shipping address provided during checkout.
  2.     Check with neighbors, building management, or household members.
  3.     Contact the shipping carrier with the tracking number to file a claim.
  4.     Report the incident to local authorities if theft is suspected.
  5.     Contact Customer Support at ordersupport@buffalotrace.com with your claim details, tracking number, and any relevant documentation.
  • Claims Process: We will assist in the investigation, but we are not responsible for packages lost or stolen after confirmed delivery. Refunds or replacements will be evaluated on a case-by-case basis, considering the carrier’s claim outcome.

10. Out-of-Stock (OOS) Items

Availability: Product availability is subject to change without notice. Items may sell out quickly and may not be restocked.

No Guarantee of Restock: We encourage customers to check back frequently for updates. However, we make no guarantees that out-of-stock items will become available again.

12. Limitation of Liability

Sazerac is not liable for indirect, incidental, or consequential damages arising from the use or inability to use our products.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.  The parties agree that any claim, action, proceeding or suit arising out of or relating to the use of the Services shall be commenced and maintained solely and exclusively in a federal or state court of competent jurisdiction located in or serving Jefferson County, Kentucky.  

Notwithstanding the foregoing, nothing in this section shall be construed to limit any consumer protection rights that you may be entitled to under the mandatory laws of your state of residence.

14. Amendments

Sazerac reserves the right to update or modify these Terms at any time. Changes will be effective upon posting to our website.
